Distance Sales Agreement

ARTICLE 1 – PARTIES

1.1 – SELLER

1.2 – BUYER

A natural or legal person who makes a purchase through Margeriecrystal.com. The buyer's information is based on the information declared during the registration and payment process.


ARTICLE 2 – SUBJECT OF THE CONTRACT

This agreement regulates the rights and obligations of the parties regarding the purchase, delivery, return and refund of products, in relation to the orders placed by the buyer through the Margerie Crystal website, within the scope of Turkish consumer protection legislation.


ARTICLE 3 – PRODUCT INFORMATION

The basic features, descriptions, and sales prices of the purchased products are listed on margeriecrystal.com.tr . All prices are in ₺ (Turkish Lira) and are valid until updated.

Product information includes:

  • Product type, quantity, model, color and price
  • Payment method

ARTICLE 4 – GENERAL PROVISIONS

4.1 – By confirming the order, the buyer declares that he/she has read, understood and accepted the preliminary information form and this contract.
4.2 – The seller undertakes to send the order to the address specified by the buyer within 10 working days at the latest (except in exceptional cases).
4.3 – If the product is delivered to a person other than the buyer and is not received, the seller has no liability.
4.4 – The seller is not responsible for delivery problems arising from third-party cargo companies.
4.5 – If the payment is not completed or is cancelled by the bank, the seller's delivery obligation is eliminated.
4.6 – If the payment is illegally cancelled or a chargeback is made after the product has been delivered, the buyer is obligated to return the product within 3 days . Shipping costs are the buyer's responsibility.
4.7 – In case of force majeure (natural disaster, transportation obstacle, etc.), the seller has the right to postpone, change or cancel the order by informing the buyer.
4.8 - Products under warranty may be returned for repair in accordance with the warranty terms. In this case, the shipping costs will be covered by the seller.


ARTICLE 5 – RIGHT OF WITHDRAWAL

The buyer may exercise his right of withdrawal within 14 calendar days from delivery without giving any reason and without paying any penalty.

Conditions of Withdrawal:

  • The product must be unused, in its original packaging and in resalable condition.
  • The notice of withdrawal must be sent in writing to info@margeriecrystal.com within 14 days .
  • The following documents and materials must be included in the return package:
  • Invoice (If a corporate invoice has been issued, a return invoice must also be attached),
  • Return form,
  • Original packaging, labels, accessories and promotional items, if any.

Once the returned product is received by the seller, the product price (excluding the initial shipping fee, if any) will be refunded to the buyer's payment method within 10 business days .

Note: For damaged products caused by the customer, a deduction may be made from the return fee.


ARTICLE 6 – PRODUCTS EXCEPT THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to the following products:

  • Custom-made products.
  • Products that are not suitable for return for hygiene reasons.
  • Products whose packaging has been opened and cannot be resold.

ARTICLE 7 – DISPUTE RESOLUTION

Any disputes that may arise between the parties will be resolved in accordance with the laws of the Republic of Turkey . The competent authorities are Consumer Arbitration Committees and Consumer Courts .


ARTICLE 8 – FINAL PROVISIONS

If the package is visibly damaged during delivery, the product must not be accepted and the seller must be notified immediately. If the damage cannot be detected after the product is received, the seller assumes no liability.

By placing an order, the buyer declares that he/she has read, understood and accepted all the terms and conditions contained in this agreement.
